Terms of Service

1. Acceptance of Terms
By accessing or using Redbark Sync (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
Redbark Sync is a platform that enables you to connect your Australian bank accounts and automatically synchronise transaction data to destinations such as Google Sheets, You Need a Budget, Notion, and custom webhooks. The Service accesses your banking data through accredited data recipient intermediaries under Australia's Consumer Data Right (CDR) framework. Redbark also provides a REST API that enables you to direct your banking data to applications or endpoints you choose, including destinations you own, control, or are authorised to use, in accordance with your instructions.
3. Eligibility
You must be at least 18 years old and an Australian resident to use this Service. By using the Service, you represent that you meet these requirements and have the authority to agree to these Terms.
4. Permitted Use — Personal Use Only
The Service and the Redbark API are provided strictly for your personal use as the individual CDR consumer whose banking data is being accessed. By using the Service, you represent that you are accessing your own banking data and directing it to destinations you own, control, or are personally authorised to use.
You must not, and must not permit any third party to:
- Use the Service or the API to access, collect, store, process, or disclose banking data on behalf of any other person, your customers, your employer, or any third party;
- Resell, sublicense, white-label, embed, wrap, proxy, or otherwise make the Service or the API (or any data obtained through them) available to third parties or to end users of your own product or service;
- Act as an intermediary, aggregator, gateway, reseller, broker, or data pipe for CDR data;
- Create or operate accounts on behalf of any other person, share your account credentials, or share API keys with any other person;
- Use the Service or the API to build, operate, or supply any product or service that provides banking data access, hosted consent, or CDR data flows to other consumers or businesses.
This restriction reflects our obligations as a CDR Representative. Under the Competition and Consumer (Consumer Data Right) Rules 2020, our CDR consent relationship is exclusively between Redbark and you as the individual consumer. We are not authorised to collect, hold, use, or disclose CDR data on behalf of any other entity's customers or end users, and we do not offer B2B, embedded, white-label, or hosted-consent access to the CDR framework.
If you wish to access CDR banking data on behalf of your own customers, you must obtain your own CDR accreditation, become a CDR Representative under another Accredited Data Recipient, or contract directly with an ADR such as Fiskil or Basiq.
Breach of this clause is a material breach of these Terms. We may, without notice, suspend or terminate your account, revoke your API keys, and withdraw all active CDR consents.
5. Account Registration
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to notify us immediately of any unauthorised use of your account.
6. Consumer Data Right (CDR) Compliance
The Service operates under Australia's Consumer Data Right regime. Redbark (SKINT AI Pty Ltd, ACN 685 364 729) is a CDR Representative of Fiskil Pty Ltd (ADR accreditation ADRBNK000246). Fiskil collects and discloses CDR data to Redbark on your behalf under Fiskil's CDR Policy, which applies to our handling of your CDR data. When you connect a bank account, you provide explicit consent for us to access specified categories of your banking data. Consents are time-limited (maximum 12 months) and can be withdrawn at any time through the Service.
7. Data Handling
- Your banking data is accessed solely to provide the synchronisation service you have requested.
- Transaction data is transmitted to the destination you select and is not stored on our servers beyond what is necessary for the sync operation.
- Authentication tokens are encrypted at rest using AES-256-GCM.
- We do not sell, share, or use your banking data for any purpose other than providing the Service.
8. Destination Integrations
By connecting a destination (such as Google Sheets, You Need a Budget, Notion, or a custom webhook), you authorise the Service to read and write data to your selected resources. The Service only accesses the specific resources you choose. For webhook destinations, you are responsible for the security and handling of data at your receiving endpoint. Your use of third-party services is also subject to their respective terms of service.
9. API Access
The Service provides a REST API that enables you to direct your own banking data to applications or endpoints you choose, including destinations you own, control, or are personally authorised to use, in accordance with your instructions. API access requires an API key issued through the Service. You are responsible for keeping your API keys confidential and for all activity conducted using your keys.
The API is for your personal use only and is subject to the restrictions in Section 4 (Permitted Use — Personal Use Only). In particular, you must not use the API to provide banking data access to your customers, end users, or any other third party, and you must not embed, wrap, proxy, white-label, or expose the API within any product or service that you offer to others. We may revoke API keys that we reasonably suspect are being used by anyone other than the account holder, or in breach of these Terms, without notice.
10. Subscriptions and Billing
The Service may offer free trial periods and paid subscription plans. Paid subscriptions are billed in advance on a monthly or yearly basis. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
11. Limitation of Liability
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law, the Privacy Act 1988 (Cth), the Competition and Consumer Act 2010 (Cth) or the Consumer Data Right Rules where to do so would be void or unlawful. Subject to those non-excludable rights:
The Service is provided “as is” without warranties of any kind. We are not liable for any loss or damage arising from your use of the Service, including but not limited to inaccuracies in synced data, service interruptions, or third-party service failures. To the maximum extent permitted by Australian law, our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.
12. Termination
You may delete your account at any time. Upon deletion, we will withdraw all active CDR consents, cancel your subscription, and delete your data from our systems. We reserve the right to suspend or terminate accounts that violate these Terms.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice. Continued use of the Service after changes constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
